Compare Mabbotts theory of punishment with the nullification theory of punishment
(Anderson). On balance, which theory do you think is the better theory of the ideal basis for
punishment? NOTE: This means that you MUST NOT conclude that the two theories are equally
good (or equally bad).1 Provide arguments in support of your conclusion. You should also
identify potential weaknesses in the position that you support and explain what makes that
position nevertheless superior in some way to the other considered. You may use either
arguments that we developed in class or which were developed in the course readings. You
can use readings from the course other than Mabbott and Anderson in order to do this. You
can also construct your own arguments that you have thought of yourself. You are
FORBIDDEN to use arguments based on materials from outside this course. This is NOT a
research paper. Of course, before arguing for or against a theory of punishment, you must
first explain what that theory is.
