Correctional Officer Gertrude Swift works at a state run prison. While on duty, she was a witness to a fight between two inmates. At the time of the fight, she had own personal cell phone (for which she paid the bills) in her pocket. Prison policy forbids employees from carrying personal phones while on the clock, and for this reason every employee is given a locker to store his or her belongings. After the fight was over, Swift put her phone in her locker. Assume there is no warrant sought by the prison. Do you think it is reasonable for the prison officials to open her locker? To remove the cell phone? To search the text and call history? To view photographs taken on the phone? Why or why not? Would you feel differently if Swift worked for a privately run prison?
