Write a research paper about Frank August Schubert’s Law and the Legal System.Your assignment is to write a case brief for Ceglia v Zuckerberg. We have spent class time discussing briefs of the cases in your textbook(Introduction to Law and the Legal System by Frank August Schubert), so you should be familiar with how to write a brief. As a model, you can use the Washington v. Glucksberg brief posted on Brightspace. Your textbook also explains a similar briefing method on p. 25 (although I would like you to use the same sections that I used in Glucksberg: Facts: Issue (phrased as a yes/no question relating to a constitutional provision or statute): Decision (phrased as a yes/no answer to the Issue, along with a brief explanation): Reasons (the very heart of the brief – including arguments from both parties to the case so that you can explain why the court deemed the “losing” party’s argument insufficient): Rule of Law (the final “takeaway” from the case that rolls into 1 [often very long!! sentence all of the basic details necessary to understand the court’s decision. The Rule of Law should enable anyone to understand the key elements of the case, simply by reading that one sentence (think of it as an index card summary of the case). I am fully aware that it is very easy and tempting to seek out case briefs online. If I find that you have used outside sources for this assignment, it will negatively impact your grade; thus, please do NOT use outside sources. The purpose of this assignment is to see how well you can identify and express, with precision, the key points in a case. I have attached the Washington v. Two further points of guidance: As with the Finstuen brief, I cautioned against using outside sources when writing your brief for this class. I mean that here, too. I will NOT grade your paper if I detect that you have used outside sources. And, finally, I will be a lot more generous in grading those briefs that are written in your own words, rather than quoting verbatim from the court opinion. Yes, sometimes, it is not possible to reword accurately what the opinion already says… and it just makes sense to quote from the opinion. But, whenever possible, writing the brief in your own words indicates to me that you fully understand the case, rather than that you can simply copy what the court has written.
