Fact PatternAfter the primary the municipal clerk certified to the county clerk and county board of elections the results of the county committee election. In one district, the clerk certified a tie vote. The results of the election are being challenged on the grounds that the clerk failed to count all of the legal votes. In the council election the losing primary candidate challenges the results asserting that the clerk, who is employed by the governing body, was biased as an election official and should not have been involved in the election because the incumbent council member is her father.
