In our two party system, the party that is not in power will often look to make policy innovations in the states. For example, during the beginning of the Trump administration the democrats, have tried to change state laws according to the democratic agenda. In Virginia, the democratically controlled legislature, along with the democratic governor, have passed control measures including background checks and red flag laws. Simillarly, during the Biden presidency, Republicans in “red states” have tried to create policies off their own.
How does this fit in with ideas of federalism presented by the court cases we have read? Can you think of examples where the states have led the federal government in terms of innovation? Environmentally? Economically? Recreationally?
