CASE BELOW:
Mr. Martinez is a 55-year-old Nicaraguan man who is presently incarcerated for offenses allegedly committed approximately 30 years ago. He was previously convicted of those offenses and sentenced to death. He sat on death row for six years until the Florida Supreme Court overturned the conviction and ordered a new trial. Mr. Martinez has a history of multiple and varied childhood traumatic experiences. His mother was reported to be drunk during the labor with him and drank throughout the pregnancy. She had a motorcycle accident while pregnant with him and also was the victim of severe domestic violence during the pregnancy. Mr. Martinez witnessed significant domestic violence between his parents as a young child until his father abandoned the family when he was 5-years-old. He witnessed an incident in which his father attempted to kill his infant sister. His father constantly terrorized the family with guns and threatened to kill everyone. His mother was neglectful and severely physically abusive. He often slept outside on concrete steps without blankets in freezing winter weather. He was tied to a tree by his mother for his misbehavior. He sustained a head injury due to being hit in the head with a hammer by his uncle. He was sexually abused by five male perpetrators between the ages of 9 and 13, two of whom were priests. He also was involved with the Sandinistas in Nicaragua and has experienced combat-related trauma. Furthermore, he was psychologically tortured by Nicaraguan law enforcement.
