Can the core Legislative Drafting principles of Grant Thornton protect, shield, buffer the Legislative Drafter / Drafter ‘good draft legislation from an overarching Policymaker ‘the politician’, the Lobbyist in small Nation State

Hypothesis:

Whether or not, the five (5) core legislative drafting principles of Grant Thornton, when applied to the Saint Lucian (small nation context) can protect, shield, buffer ‘good draft legislation’ through a Legislative Drafter / Legislative Draft from an ‘overarching’ Policy Maker ‘the Politician’, Lobbyist.

The aim of this essay is to analyze these core legislative principles with a view to ascertain which of the 5 are more critical to ensuring the legislative draft remains pristine or true the Drafting Instruction, within our Saint Lucian commonwealth context.

Methodology:

Compare the strengths & weaknesses of Grant Thornton’s Legislative Drafting principles in our present-day modern, technologically savvy societies where interaction is instant, blurring the lines between the legislative drafter and policy maker and the effect on ‘good practical law’.

Juxtaposing the view of Prof. Helen Xanthaki, who proffers a perspective that ‘Cross- Fertilization’ between Common Law and Civil Law jurisdictions offers a more practical approach to ‘good draft legislation’.

– Further, which of Thornton’s five (5) are critical to ensuring the Legislative Draft remains pristine and true to the initial issued Drafting Instruction.

As part of my Primary research, a ‘Questionnaire’ will be conducted amongst the Legislative Drafting Unit of our Attorney General Chambers to ascertain, or with a view to ascertaining their procedures, exposures to a policy maker and experiences once a written Drafting Instruction is issued, through to the production of a piece of draft legislation.

Conclusion:

With the primary research results of the questionnaire, and already established secondary research principles of Grant Thornton, I will show that despite our small nation context, where political overtures appear to be more amplified and dramatic, the integrity of legislative draft is buffered.
