Follow this abstract:
The paper will focus on the European Union Court of Justice (ECJ) as the sole institution with judicial power within the European Union (EU). The ECJ is of essential significance to the policy process of the EU. The whole system could not operate without its interpretation of the treaties that are often fragmented and vague. The Paris Agreement and the Treaty of Rome have strengthened the role of the ECJ on the international level, making it a powerful intuition that even national governments are wary of. I will be looking at the concept of supranationalization in correlation with the ECJ. The process of integration of the EU has led to further supranationalization of certain laws by the ECJ. The main question of the essay is “what is the role of ECJ in the Supranationalization of the European union?”. The concept of Supranationalization will be elaborated on. A selection of EU law cases will be examined that had a big impact on the institution’s own legitimacy. Cases such as Costa v. ENEL, which established the supremacy of EU law over national law, and the Van Gend en Loos, which established the direct effect of EU law on the legal orders of member states, for example, had great influence on the status quo inside the legal system of the member states. Furthermore, the authority of the ECJ will be put into perspective in comparison to national states and other EU institutions.
Things to remember to do:
– Introduce the ECJ
– Introduce how the ECJ came into more power (through introducing the treaties that gave it the power)
– Introduce supranationalization
– Talk about the role of the ECJ in European integration
– Impact of ECJ on EU policy making, integration and supernationalization
– Mention cases that established EU supremacy as examples
– To what extend did the nation states accept the ruling of the supremacy law (e.g. German constitutional court was against it)
– discuss case of supremacy of EU law extensively (Costa v. ENEL)
– Difference in power between ECJ and other institutions as well as ECJ and the member states
I added some papers I found online that might help in the research. you can of course add more of your own sources, they should be peer-reviewed of course.
It is important that the paper includes (1) a clear and precise research question; (2) brief explanation why this question is relevant and how it relates to the broader academic literature; (3) a clear and structured argument to answer the research question; (4) theoretical background and method. Last but not least, the paper is expected to be clearly written, well-referenced and free of spelling errors or typos.
PLEASE: add page numbers next to each source in the in-text citations because I will double-check all of them for plagiarism so it is easier for both of us if you check that you’re using the correct sources. (only saying this because I’ve had bad experiences with writecixrs that don’t care at all)
